As I said previously, hard cases make bad law (using "law"
metaphorically here, of course.)

The intention here is repeated, bulk email.

I don't really give a rat's patootie whether it's coming from
nod0ctormedz.com or microsoft.com.

Advertising costs. And that cost needs to be passed on to the
advertisers.

What the fine-grained rules might be is a marketing decision.

But you might as well tell e-bay they can't skim off people's sales.

I'm sure they'd have much the same reaction I do.
