Why?
Because a copyright notice is a statement about a fact that we have no intention of changing (we have not planned to do copyright assignment).

We *are* debating copying conditions.

The "list of conditions and the following disclaimer" refer to the
copying conditions.

The BSD and GPL are similar in this respect, at least if I understand
what you are getting at.
So the BSD license may have the same problem as the GPL license in this regard.
