The user might be able to set a "global" presence state, e.g. 
his person status,  via his IM client, or through a
personal web portal, which allows the user to 
administer his presence state.  He might want to set his  status
to "unavailable for all communications".  In this case it wouldn't
matter what the phone reports (on-the-phone, or off-the-phone)
after the user sets his person level status.
